By accessing or using our website, you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree with any part of these terms, you must stop using our Service immediately.

These Terms apply to all users, including visitors, customers, and businesses who access our website.

2. Our Services

EmbroidX specializes in professional embroidery digitization services. Our platform allows customers to submit logo designs or artwork, which we convert into machine-readable embroidery files.

✔ Manual Review for Large Orders – Orders above $100 require review before a payment link is sent.
✔ Secure Online Payments – Processed through Stripe, PayPal, or Bank Transfer.

3. Intellectual Property

All content on this website, including logos, graphics, text, software, and digital embroidery files, is the exclusive property of EmbroidX and is protected by copyright, trademark, and intellectual property laws.

  • You MAY NOT resell, redistribute, modify, or reproduce any of our embroidery files without explicit written permission.
  • You MAY ONLY submit files for digitization if you own them or have legal rights to use them.
  • If you believe your intellectual property rights have been violated, please contact [email protected].

4. Order Processing & Payments

  • Instant Payment Orders: Orders below $100 can be paid immediately at checkout.
  • Quote-Based Orders: Orders above $100 will be manually reviewed before a payment link is sent.
  • Payment Methods: We accept Stripe, PayPal, and Bank Transfers.
  • Taxes & VAT: Prices may or may not include VAT, depending on the customer's location.
  • Finality of Orders: Once payment is completed, embroidery files are final and non-refundable.

5. Refund & Cancellation Policy

  • Since our products are digital embroidery files, all sales are final after file delivery.

    Exceptions for Refunds:
    ✔ If we deliver an incorrect or defective file, we will revise or replace it at no cost.
    ✔ If we are unable to process your design, we will issue a full refund.
    ✔ Refund requests must be submitted within 24 hours of purchase to [email protected].

    🚫 Refunds are NOT provided for:

    • Customer changing their mind after purchasing.
    • Issues related to fabric distortion, thread breaks, or incorrect machine settings.

6. Third-Party Services

  • We may use third-party services such as payment gateways, analytics, and hosting providers. By using our site, you acknowledge that:

    • We are not responsible for third-party content, policies, or actions.
    • Any disputes regarding third-party services must be resolved with that provider, not EmbroidX.

    If you leave our website via an external link, we encourage you to read their terms and privacy policies.

7. User Accounts & Security

    • You may need to create an account to access certain services.
    • You are responsible for keeping your account credentials secure.
    • You must notify us immediately of unauthorized account activity.
    • Sharing your account login details is strictly prohibited.

    • EmbroidX is NOT responsible for:

      • Any financial losses, damages, or production errors resulting from the use of our embroidery digitization files.
      • Machine errors, fabric issues, thread breaks, or incorrect embroidery settings.
      • Customers not testing embroidery files before bulk production.

      Customers assume full responsibility for testing files on sample fabrics before large-scale embroidery production.

9. No Guarantee of Final Embroidery Outcome

  • Embroidery results depend on various factors such as:

    • Machine type & settings
    • Fabric material & thickness
    • Thread quality

    We do not guarantee that our digitized files will work perfectly on all embroidery machines. Customers should conduct sample tests before final production.

10. Chargebacks & Payment Disputes

  • 🚨 All transactions are FINAL once an embroidery file has been delivered.

    Customers agree not to initiate chargebacks or disputes for completed digital file deliveries.

    • If a customer files a dispute, we reserve the right to provide proof of file delivery and take legal action if necessary.
    • Fraudulent chargebacks will result in account suspension and legal action.

11. Governing Law & Jurisdiction

  • These Terms are governed by Portuguese law. Any disputes arising from or relating to these Terms shall be settled in the courts of Portugal.

12. Changes to These Terms

  • EmbroidX reserves the right to modify or update these Terms at any time.

    • If changes are significant, we will notify users 30 days in advance.
    • Continued use of our website means you accept the new Terms.
